1. Acceptance of Terms

Welcome to GiftCash NG ("we", "us", "our"). By accessing or using our website at giftcashng.com and our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

You must be at least 18 years old to use our services. By creating an account, you confirm that you are 18 or older and legally capable of entering into binding contracts.

2. Services Description

We operate a platform that allows users to:

• Sell gift cards (Steam, Amazon, iTunes, Google Play, Visa prepaid, etc.) for cash payouts.
• Sell digital assets (USDT, Bitcoin, PayPal balance) for local currency.
• Receive payouts via bank transfer, mobile money, cryptocurrency, or PayPal.
• Store funds in a wallet for future withdrawals.

We act as an intermediary between buyers and secondary market liquidity providers. We do not issue gift cards and are not affiliated with the card issuers.

3. Account Registration

To use our services, you must:

• Provide accurate and complete information during registration.
• Maintain the security of your password and account.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activities under your account.
• Create only one account per person.

Providing false information may result in account suspension and forfeiture of any pending payouts.

4. Gift Card Sales

When selling a gift card, you represent and warrant that:

• You are the legal owner of the gift card.
• The card was obtained through lawful means.
• The card has not been redeemed, reported stolen, or fraudulently obtained.
• The face value and currency you declare are accurate.
• The card images you upload are clear and genuine.

We reserve the right to reject any order if the card is invalid, already redeemed, or shows signs of fraud.

5. Pricing and Rates

The payout rate for each gift card is determined by:

• The card type and its base currency (USD, EUR, GBP, etc.).
• The face value (larger denominations may receive better rates).
• Live forex rates for converting USD payout to your local currency.
• Market conditions and our operational costs.

Rates are displayed before you submit an order and are locked in once you submit. We reserve the right to adjust rates at any time without prior notice, but locked orders will be honored at the locked rate.

6. Order Processing

After you submit an order:

• Our team verifies the card balance and validity (usually 5-30 minutes during business hours).
• Some card types (e.g., supermarket cards) may take 1-3 hours to verify.
• Once verified, the payout is credited to your wallet balance.
• You can then withdraw via your chosen payout method.

We may request additional verification (ID, proof of purchase) for large transactions or suspicious activity.

7. Prohibited Activities

You agree not to:

• Sell gift cards obtained through fraud, theft, or unauthorized means.
• Sell gift cards reported lost or stolen.
• Submit fake, altered, or already-redeemed card images.
• Use the platform for money laundering or terrorist financing.
• Attempt to manipulate rates, exploit bugs, or gain unauthorized system access.
• Create multiple accounts to circumvent limits or restrictions.
• Resell or redistribute our services without authorization.

Violations may result in immediate account suspension, forfeiture of pending payouts, and reporting to law enforcement.

8. Wallet and Withdrawals

Your wallet balance represents funds owed to you. Withdrawals are processed based on your selected method and country:

• Bank transfer: 1-24 hours (depending on bank and country).
• Mobile money: Usually instant, up to 24 hours.
• Cryptocurrency: 10-60 minutes after blockchain confirmation.
• PayPal: 1-24 hours.

Minimum withdrawal amount may apply. We are not responsible for delays caused by payment processors or incorrect payout details provided by you.

9. Fees

We do not charge registration or account maintenance fees. Our revenue comes from the spread between the card's market value and the payout we offer. Withdrawal fees (if any) are displayed at the time of withdrawal request and depend on the payout method and country.

10. Refund Policy

Once a gift card is verified and the payout is credited to your wallet, the transaction is final and cannot be reversed. If an order is rejected, no payout is made and the card details are deleted from our system within 90 days.

If you believe an error has occurred, contact us within 7 days of the transaction at support@giftcashng.com.

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability for any claim is limited to the payout amount of the specific order in dispute.
• We are not responsible for failures of payment processors, banks, or blockchain networks.
• We are not liable for losses due to incorrect payout details you provide.
• We are not liable for gift card deactivation by the issuer after payout.

12. Account Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms.
• Fraudulent or suspicious activity is detected.
• We are required to do so by law or regulatory authority.
• Your account is inactive for more than 24 months.

Upon termination, any pending payouts will be processed if your account is in good standing. We will return any verified wallet balance to your designated payout method within 30 days.

13. Anti-Money Laundering (AML) and KYC

We comply with AML regulations in the countries we operate. We may:

• Require identity verification (KYC) for transactions above certain thresholds.
• Report suspicious transactions to relevant authorities.
• Freeze accounts under investigation.
• Retain transaction records for 7 years as required by law.

14. Intellectual Property

All content on our website (logos, text, graphics, software) is owned by GiftCash NG or licensed to us. You may not copy, reproduce, or distribute our content without written permission.

15. Governing Law

These Terms are governed by the laws of Nigeria, with consideration for the laws of the user's country of residence. Any disputes will be resolved through negotiation first, then through arbitration in Lagos, Nigeria, if necessary.

16. Changes to Terms

We may update these Terms at any time. Significant changes will be notified by email or a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
